Man Charged In Court For His Involvement In Cheating A Foreign Victim And For Taking Part In The Management Of A Company While Being An Undischarged Bankrupt

A 53-year-old man has been charged in court on 21 March 2023 for his suspected involvement in cheating a foreign victim. He had allegedly arranged to ship a used motor vehicle to the victim when he did not intend to do so after receiving payment.

Investigations revealed that between July and August 2020, the foreign victim paid a company managed by the man US$ 27,000 to purchase and ship the vehicle overseas. However, the man allegedly had no intention to deliver the vehicle and repeatedly deceived the victim that the vehicle was being shipped. Further, investigations revealed that the man was an undischarged bankrupt who directly took part in the management of the company without permission from the Court.

The man has been charged with cheating under Section 417 of the Penal Code, read with Section 124(4) of the Criminal Procedure Code 2010, which is punishable with imprisonment for a term which may extend to three years, a fine, or both.

The man has also been charged under Section 148(1) of the Companies Act for contravention of the restriction on an undischarged bankrupt, which is punishable with a fine not exceeding $10,000, to imprisonment for a term not exceeding two years, or both.

The Police take a serious stance against any person involved in cheating. Perpetrator and undischarged bankrupts who manage companies without permission from the Court will be dealt with in accordance with the law.
