Five Charged For Unauthorised Access To Computer Materials And Assisting In Carrying On The Business Of Unlicensed Moneylending

The Police have charged five men for their suspected involvement in unauthorised access to computer materials and assisting in carrying on the business of unlicensed moneylending. 

On 31 July 2019, the Police arrested a 28-year-old man for assisting in carrying on the business of unlicensed moneylending. Two other men, aged 28 and 29, were subsequently arrested in Malaysia, with the assistance from the Royal Malaysia Police, pursuant to a warrant of arrest issued by the State Courts of Singapore, for their suspected involvement in unauthorised access of computer materials. Both men were subsequently brought back to Singapore on 1 August 2019. All three men have been charged in court on 3 August 2019.

Following the arrest of the three men, the Police actively pursued viable leads and arrested two more men, aged 28 and 40, on 5 August 2019 for unauthorised access of computer materials and assisting in carrying on the business of unlicensed moneylending respectively. Both men have been charged in court on 6 August 2019.

Under the Computer Misuse Act, anyone found guilty of unauthorised access to computer materials shall be liable to a fine not exceeding $5000, or to imprisonment for a term not exceeding two years, or to both. Under the Moneylenders Act (Revised Edition 2010), first time offenders found guilty of assisting in carrying on the business of unlicensed moneylending shall be liable to a fine not less than $30,000 and not more than $300,000 with mandatory imprisonment of up to four years, and mandatory caning of up to six strokes. In the case of a second or subsequent conviction, offenders shall be liable to a fine of not less than $30,000 and not more than $300,000 with mandatory imprisonment of up to seven years, and mandatory caning of up to 12 strokes.
