The Police have arrested two men, aged 25 and 41, for their suspected involvement in obstructing the course of justice, and an agreement to indemnify against bail liability, in relation to the release of a 39-year-old man on court bail.
On 1 April 2025, the 41-year-old man had allegedly obstructed the course of justice by posing as an errant bailor for the 39-year-old man, who was not known to him, for money. His actions enabled the release of the 39-year-old man who was remanded in prison at the time. Additionally, the 41-year-old man also allegedly entered into an illegal agreement with a third party to indemnify himself against any losses if the 39-year-old man failed to comply with his bail conditions. Subsequently, the 41-year-old man lodged a police report attempting to deny involvement in the matter by falsely claiming that he had maintained regular contact with the 39-year-old man before eventually losing contact with him.
On the same date, the 25-year-old man had allegedly obstructed the course of justice by driving to the prison and fetching the 39-year-old man after the latter was released on bail and brought him to a hotel where the 25-year-old man paid for a room to house the 39-year-old man. The 25-year-old man is also believed to have abetted the illegal agreement between the 41-year-old man and the same third party by couriering the bail quantum in cash to the 41-year-old man to facilitate the posting of bail.
The 39-year-old man subsequently absconded while on bail and failed to attend a court hearing for charges in relation to his involvement in his own court case. The State Courts have issued a warrant of arrest against him and the Police are working with foreign law enforcement counterparts to trace his whereabouts.
The two men will be charged in court on 22 July 2025. The 41-year-old man will be charged for (i) obstructing the course of justice under Section 204A of the Penal Code 1871, (ii) entering into an agreement to indemnify against any liability under Section 106A of the Criminal Procedure Code 2010 and (iii) providing false information with intent to cause a public servant to use his lawful power to another person under Section 182 of the Penal Code 1871. The 25-year-old man will be charged for (i) obstructing the course of justice under Section 204A of the Penal Code 1871 and (ii) abetting the entering into of an agreement to indemnify against any liability under Section 106A of the Criminal Procedure Code 2010 read with Section 109 of the Penal Code 1871.
The offence of obstructing the course of justice carries a maximum punishment of seven years' imprisonment, or a fine, or both while the offence of entering into an agreement to indemnify against any liability carries a maximum punishment of three years' imprisonment, or a fine, or both. For the offence of providing false information with intent to cause a public servant to use his lawful power to another person, this carries a maximum punishment of two years imprisonment, or a fine, or both.
The Police take a serious view of acts that interfere with the administration of justice, and offenders will be dealt with in accordance with the law.
